LEGAL AND COVENANTS COMMITTEE
JULY 10, 2007
I – Applications
Submitted the committee recommendation concerning the Reba Chambers application seeking permission to install additional kitchen cabinets and make other modifications to her unit. The committee recommended approval.
II – Inspections
The committee – again – is asking that the Board initiate an annual inspection of all of the storage units in the two buildings. The committee is of the opinion that it is an obligation of the Board to do this for health and safety reasons.
III – Rules violation sanctions
The committee is of the opinion that more affirmative action is necessary as to one or more of the ongoing violations of the guidelines. The By-Laws and Guidelines provide for a procedure for enforcing the rules and for imposing sanctions for failure to follow the rules. In this regard:
a) The committee seeks approval to work with SCS to send out the appropriate notice to those unit owners not in compliance and who have ignored previous notices.
b) The Committee suggests 2nd Monday of the month – at 7:30 p.m. – to coincide with the Covenants Committee meetings - as an appropriate time and place for the Board to hold the sanctions hearings provided for in the Guidelines.
c) The Committee requests Board approval allowing the Covenants’ Committee to generate routine notices of violations directly to SCS without waiting for the bi-monthly board meetings. The Committee would give notice to the Board prior to sending the list of violations to SCS.
